When you provide your data through our programs, courses, or coaching services, your information may be processed by these third-party platforms acting as processors on our behalf. If you attend an event, participate in a webinar, or otherwise contact us, you may also provide similar information.

From Third Parties

We may obtain information through marketing partners (such as advertising and social media platforms), vendors, and other third parties. This information can include your name, contact information, and content that is publicly available. We may also receive information from platform providers (such as GoHighLevel, Meta, or Google) in connection with services we use to operate the Platform.

Automatically When You Use Our Platform

We collect information about how you interact with the Platform, including information about your device (such as IP address, browser type, and operating system), the pages you visit, the actions you take on our Platform, and through the use of cookies, pixel tags, and similar technologies. Personal Data may be freely provided by the User, or, in case of Usage Data, collected automatically when using this Application. Unless specified otherwise, all Data requested by this Application is mandatory and failure to provide this Data may make it impossible for this Application to provide its services.

Users who are uncertain about which Personal Data is mandatory are welcome to contact the Owner.

Users are responsible for any third-party Personal Data obtained, published or shared through this Application.

3. How We Use Your Information

We use Personal Information that we collect about you or that you provide to us for the following purposes:

To Provide and Improve Our Services

We use your information to deliver our coaching programs, courses, digital content, and services; to personalize your experience on the Platform; to process transactions; and to develop and improve new products, services, and technologies.

4. When We Share Your Information

We do not sell your Personal Information for monetary consideration. We do not rent, trade, or share your Personal Information with third parties for their own independent marketing or promotional purposes.

However, certain disclosures described below — such as those involving analytics providers and social media platforms — may be classified as a "sale" or "share" under California and other US state privacy laws due to the broad definitions in those statutes. With Trusted Service Providers (Limited Sharing)

We may share your information with trusted third parties who assist us in operating our website, conducting our business, processing payments, or servicing you, so long as those parties agree to keep this information confidential and use it solely for the purpose for which it was provided. These service providers include:

1. Payment Processors

We share billing and payment information with Stripe, PayPal, and Intuit solely for the purpose of processing your payments. These processors do not have access to your Personal Information beyond what is strictly necessary to complete your transaction. Each processor maintains its own privacy policy governing how it handles your payment data.

2. Email Service Providers

We share your email address and name with email service providers solely for the purpose of sending communications you have opted into receiving, including newsletters, program updates, and marketing materials you have consented to. You may opt out of these communications at any time using the unsubscribe link in any email or by contacting us.

3. Website Hosting Services

We share technical and usage data with website hosting services solely for the purpose of hosting our website and its content, ensuring uptime, security, and proper functioning of the Platform.

4. SMS Message Aggregators and Providers

We share your phone number with SMS aggregators and text messaging service providers solely for the purpose of delivering text messages you have opted into receiving. See Section 10 (Text Messaging and SMS) for special provisions regarding SMS data protection.

5. CRM Platform — GoHighLevel (White-Label Services)

We use GoHighLevel (HighLevel Inc.) as a white-labeled CRM platform to manage client relationships, deliver programs and courses, host landing pages, process forms, and send communications. Please be aware of the following regarding this service:

  • Third-Party Platform: GoHighLevel is a third-party platform that we provide access to under our own brand (BIOM™ Biohacking Multidimensional / Monica Marcela Coach). While the interface may carry our branding, the underlying technology and data processing infrastructure is operated by HighLevel Inc.
  • Processor Role: GoHighLevel acts as a data processor on our behalf. They process your Personal Information solely under our instructions and in accordance with our data processing agreement with them.
  • Data Processed: Name, email address, phone number, program enrollment data, communication history, form submissions, usage data, and trackers.
  • Place of Processing: United States.
  • Their Privacy Policy: GoHighLevel Privacy Policy

If you are a client or affiliate who has been given access to CRM services under our brand, please be aware that your use of the platform is subject to both this Privacy Policy and GoHighLevel's terms and privacy policy. We do not share your CRM data with affiliates or third parties for marketing or promotional purposes.

With Analytics Providers

We do not share any personally identifying information with analytics providers. However, we use analytics services such as Google Analytics to help us monitor and analyze web traffic and user behavior on the Platform. These services may automatically collect data such as Trackers and Usage Data through your interaction with our website. This data is used solely to improve our services and understand how users interact with our Platform. Due to the nature of these integrations, certain usage information may be accessible to the analytics provider, which under some US state privacy laws may be classified as a "sale" due to the broad definitions in those statutes. We do not use analytics data for targeted advertising.

With Social Media Platforms

If you interact with social media widgets or buttons embedded on our Platform (such as Meta/Facebook Like buttons), those platforms may collect traffic data for the pages where they are installed, even when you do not actively use them. This interaction is subject to your privacy settings on each social network. We recommend logging out from social media services before browsing our Platform if you do not wish this data to be connected to your profile.

With Advertising and Marketing Partners

We may share limited, anonymized information with third-party partners to deliver advertising content and study the effectiveness of our campaigns. We do not share your name, email address, phone number, or other directly identifying information with advertising partners unless you have given explicit consent.

For Legal, Regulatory, or Related Purposes

We may disclose your information to the extent required by law or if we have a good-faith belief that such disclosure is necessary to comply with official investigations or legal proceedings, including in response to subpoenas, search warrants, or court orders.

Sales, Mergers, and Acquisitions

We design our Platform and select our service providers to provide reasonable and appropriate administrative, technical, and organizational security measures to protect your Personal Information against risks such as temporary or permanent loss, destruction, and unauthorized or unlawful access, alteration, use, or disclosure.

We require our suppliers and vendors to apply similar protections when they access or use Personal Information that we share with them. However, no technology, data transmission, or system can be guaranteed to be 100% secure.

If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that your password or account credentials have been compromised), please immediately notify us by contacting us at [email protected].

6. Data Retention

We will only retain your Personal Information for as long as reasonably necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements. We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for Personal Information, we consider the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process your Personal Information and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.

In some circumstances you can ask us to delete your data (see the relevant rights sections below for further information). In some circumstances we may anonymize your Personal Information (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Owner's legitimate interests shall be retained as long as needed to fulfill such purposes. Users may find specific information regarding the legitimate interests pursued by the Owner within the relevant sections of this document or by contacting the Owner.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

7. Children's Privacy

We do not knowingly collect, use, disclose, sell, or share Personal Information from children under 16. Our Platform, programs, and services are not directed to children under 16.

If we learn that we have collected the Personal Information of a child under 16, we will take steps to delete the information as soon as possible. If you are under 16, do not provide any information about yourself to us, including your name, address, telephone number, or email address.

We are not responsible for the practices employed by websites or services linked to or from the Platform, including the information or content contained therein. This Privacy Policy does not address, and we are not responsible for, the policies and practices of third parties or other organizations that are not operating on our behalf.

This includes: (a) any third party operating any site or service to which the Platform links — the inclusion of a link on the Platform does not imply endorsement of the linked site or service by us; or (b) any app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer — including any Personal Information you disclose to other organizations through or in connection with the Platform.

9. Do Not Track

Some browsers incorporate a "Do Not Track" ("DNT") feature that, when turned on, signals to websites and online services that you do not want to be tracked. At this time, the Platform does not respond to DNT signals. You can, however, manage your cookie preferences as described in the Cookie Policy section below.

10. Text Messaging and SMS

If you opt in to receive text messages or SMS communications from us, please be aware of the following:

SMS Data Protection

We do not share your phone number, text messaging opt-in data, or consent information with any third parties for marketing or promotional purposes. The only exception is the SMS aggregators and service providers strictly necessary to deliver your text messages. Your mobile information will not be shared with third parties or affiliates for promotional purposes under any circumstances.

SMS Service Delivery

Our SMS and text messaging services are delivered through our CRM platform (GoHighLevel / HighLevel Inc.), which uses third-party SMS aggregators and carriers to transmit messages. These providers receive your phone number solely for the purpose of delivering the messages you have opted into. They are contractually prohibited from using your information for any other purpose.

Your SMS Rights

  • Opt-In Required: You will only receive text messages from us if you have explicitly opted in to receive them.
  • Opt-Out at Any Time: You may opt out of text messages at any time by replying STOP to any message, or by contacting us at [email protected].
  • Help: Reply HELP to any message for assistance or contact information.
  • Message Frequency: Message frequency may vary depending on the nature of your interaction with us and the programs or services you are enrolled in.
  • Rates: Message and data rates may apply depending on your carrier and plan.
  • No Condition of Purchase: Opting in to receive text messages is not a condition of purchasing any product or service from us.

White-Label CRM and SMS Services

For clients and affiliates who access our CRM services (powered by GoHighLevel) under our brand, please be aware of the following regarding SMS functionality:

  • The CRM platform is a third-party service (HighLevel Inc.) that we provide access to under our specific brand names (BIOM™ Biohacking Multidimensional / Monica Marcela Coach).
  • SMS messages sent through the CRM are processed by HighLevel Inc. and their SMS aggregator partners solely for the purpose of delivering messages on your behalf or on our behalf.
  • All SMS opt-in data, consent records, and phone numbers collected through the CRM are subject to the same protections described in this section — they will not be shared with third parties or affiliates for marketing or promotional purposes.
  • If you are an affiliate or client using the CRM to send SMS messages to your own contacts, you are responsible for obtaining proper opt-in consent from your recipients and complying with all applicable telecommunications laws (including the TCPA and state-level regulations).

11. Cookie Policy

This Application uses Trackers. Cookies and similar technologies are used to make our website operate, work more efficiently, and provide analytic information. Any use of Cookies — or of other tracking tools — by this Application or by the owners of third-party services used by this Application serves the purpose of providing the Service required by the User, in addition to any other purposes described in the present document.

You can manage your cookie preferences through your browser settings. Please note that disabling cookies may affect the functionality of the Platform.

Personal Data is collected for the following purposes and using the following services:

Access to Third-Party Accounts

This type of service allows this Application to access Data from your account on a third-party service and perform actions with it. These services are not activated automatically, but require explicit authorization by the User.

Facebook Account Access (Meta Platforms, Inc.)

This service allows this Application to connect with the User's account on the Facebook social network, provided by Meta Platforms, Inc. Permissions asked include Website access. Personal Data processed includes Website data. Processing takes place in the United States. Under CCPA, this is categorized as internet or other electronic network activity information. This data may be disclosed to Meta Platforms, Inc. and is retained for the time necessary to fulfill the purpose. Under California privacy law, this processing may constitute a "sale." Analytics

The services contained in this section enable the Owner to monitor and analyze web traffic and can be used to keep track of User behavior.

Google Analytics — Universal Analytics (Google LLC)

Google Analytics (Universal Analytics) is a web analysis service provided by Google LLC. Google utilizes the Data collected to track and examine the use of this Application, to prepare reports on its activities and share them with other Google services. Google may use the Data collected to contextualize and personalize the ads of its own advertising network. Personal Data processed includes Trackers and Usage Data. Processing takes place in the United States. Under CCPA, this is categorized as internet or other electronic network activity information. This data is disclosed to Google LLC and is retained for the time necessary to fulfill the purpose. Under US state privacy laws, this processing may constitute a "sale." Contacting the User

Contact Form (this Application)

By filling in the contact form with their Data, the User authorizes this Application to use these details to reply to requests for information, quotes, or any other kind of request as indicated by the form's header. We do not share contact form submissions with any third parties. Personal Data processed includes country and is categorized as Identifiers under CCPA. This data is processed internally through our platform provider (HighLevel Inc., acting as a processor on our behalf) and is retained for the time necessary to fulfill the purpose.

Interaction with External Social Networks and Platforms

This type of service allows interaction with social networks or other external platforms directly from the pages of this Application. The interaction and information obtained through this Application are always subject to the User's privacy settings for each social network. This type of service might still collect traffic data for the pages where the service is installed, even when Users do not use it. It is recommended to log out from the respective services to make sure that the processed data on this Application isn't being connected back to the User's profile.

Facebook Like Button and Social Widgets (Meta Platforms, Inc.)

The Facebook Like button and social widgets are services allowing interaction with the Facebook social network provided by Meta Platforms, Inc. Personal Data processed includes Trackers and Usage Data. Processing takes place in the United States. Under CCPA, this is categorized as internet or other electronic network activity information. This data is disclosed to Meta Platforms, Inc. and is retained for the time necessary to fulfill the purpose. Under US state privacy laws, this processing may constitute a "sale." Platform and Hosting Services

GoHighLevel (HighLevel Inc.)

We use GoHighLevel as our primary platform for website hosting, landing pages, forms, email delivery, SMS/text messaging, CRM, and course/program delivery. GoHighLevel acts as a processor on our behalf and processes your Personal Information in accordance with their privacy policy. Personal Data processed includes name, email address, phone number, Usage Data, and Trackers. Processing takes place in the United States. HighLevel Inc. serves as a service provider and processor. Data is retained for the time necessary to fulfill the purpose. This processing does not constitute a sale under US state privacy laws. You can review HighLevel's Privacy Policy.

13. Notice at Collection — US Users

The following provides you with notice about the categories of Personal Information collected or disclosed in the past 12 months so that you can exercise meaningful control over our use of that Information.

Categories of Personal Information Collected

Internet and Electronic Network Activity Information

This category includes Trackers, Usage Data, and Website data. We collect this information for the purposes of analytics, interaction with external social networks, and access to third-party accounts. This data is disclosed to Google LLC, Meta Platforms, Inc., and HighLevel Inc. Data is retained for the time necessary to fulfill the purpose for which it was collected.

Identifiers (Country)

We collect country information through our contact forms for the purpose of responding to user inquiries. We do not share this data with any third parties. It is processed internally through our platform provider and is not used for targeted advertising. Data is retained for the time necessary to fulfill the purpose for which it was collected.

Identifiers and California Consumer Records (Name, Email, Phone Number)

We collect your name, email address, and phone number for service delivery, communication, customer support, and business operations. This data is processed by HighLevel Inc. acting as a processor on our behalf. This data is not sold or shared under any US state privacy law and is not used for targeted advertising. Data is retained for the time necessary to fulfill the purpose for which it was collected.

Important Notes

We will not process your Information for unexpected purposes, or for purposes that are not reasonably necessary to and compatible with the purposes originally disclosed, without your consent.

All the above categories exclude text messaging originator opt-in data and consent. This information will not be shared with any third parties, excluding aggregators and providers of the text messaging services necessary to deliver the SMS service.

What Are the Sources of the Personal Information We Collect?

We collect the above-mentioned categories of Personal Information, either directly or indirectly, from you when you use this Application. For example, you directly provide your Personal Information when you submit requests via any forms on this Application. You also provide Personal Information indirectly when you navigate this Application, as Personal Information about you is automatically observed and collected. Finally, we may collect your Personal Information from third parties that work with us in connection with the Service or with the functioning of this Application and features thereof.

The Owner may process Personal Data relating to Users if one of the following applies:

  • Personal Data collected for purposes related to the performance of a contract between the Owner and the User shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Owner's legitimate interests shall be retained as long as needed to fulfill such purposes.

The Owner may be allowed to retain Personal Data for a longer period whenever the User has given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Owner may be obliged to retain Personal Data for a longer period whenever required to fulfil a legal obligation or upon order of an authority.

Once the retention period expires, Personal Data shall be deleted. Therefore, the right of access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

16. Rights of Users Based on the GDPR

Users may exercise certain rights regarding their Data processed by the Owner. In particular, Users have the right to do the following, to the extent permitted by law:

  • Withdraw their consent at any time where they have previously given consent to the processing of their Personal Data.
  • Object to processing of their Data if the processing is carried out on a legal basis other than consent.

User
